Our subscription provides instant access searches whereby concrete results are often obtained on line within seconds. The capability to obtain credit reports as well as the capability to adversely affect one's credit rating by reporting the amount due you as being past due are both part of the membership privileges with Experian We will adversely affect one's credit after obtaining your authorization. This information will remain on the debtor's records for seven (7) years!
LITIGATION
Where the account remains unpaid and has a balance worthy of litigation, we will, with your authorization, commence a lawsuit against the debtor. As such, we will not begin litigating without your prior written authorization. Generally, we will consider recommending litigation where we believe the debtor has the means to pay. In this respect, our ability, where permissible, to run credit reports via the Internet provides fast and efficient information that assists in our analysis whether to recommend litigation. When litigating, in addition to seeking recovery of the principal amount past due, we will seek interest from the last date of service (the legal rate of interest in New York is 9%). Moreover, we will seek reimbursement for court costs and disbursements. Judgments are collectible up to twenty (20) years in New York.
